Have Approved I-140, Returned to India

Hi All,

I was curious to know if I can make any use of the approved I-140 petition I have while I was in US for seven years of which I worked five years.My PD is Jan 2003 EB3.

Would it be possible for me to use this in future anytime if so I decide to pursue an opportunity in US.

Your approved I-140 will help you to preserve the priorty date when you apply for GC (Employment Based) in future. The above is applicable as long as your previous employer does not revoke the approved I-140.

Thank you manwithnoname, atleast you have an answer.I guess my move back home has helped me make 12% of my savings while doing nothing as the rupee appreciated.

I could not survive in US to collect the GC.Its a painful game.

I have heard conflicting opinions about whether a previously approved 140 needs to remain uncanceled or not for a future immigrant petition(140) to be able to receive that priority date. Obviously the preferred option is that it remains open. You should keep a copy of it if you have one.
The other issue you need to consider is that if my memory serves me right, on your visa application form in the US consulate, there is a question asking whether you have applied for or approved for an immigrant petition. I am not sure how an officer will interpret that when you check yes. I suppose it might not matter for visas such as H1b but I am not sure exactly. I know it will certainly impact your ability to get a visitors visa, since in their eyes you have shown "immigrant intent".

I agree with you about the pain we endure. It is most unfortunate. I'm in my 9th yr here and my wife 2 yrs longer than that, and we are waiting. This type of thing is truly not the policy befitting of such a great immigrant nation.

Aside from your 12% gain which you must be smiling about! How has your experience been?
 
Keep your i140.

It is not BAD that you returned to India.
Keep your i140 and make sure your employer in US will not use your Labour for another body. That way you retain your priority date and when [WHEN] ever your PD gets current you can actually apply for consular processing- Walk into the embassy and hopefully get a GC.

If and when you get a GC - Dont be LoST as to what you want to do. Please come over to the US stay here for atleast 5 years working and get your citizenship. Atleast you will make way for your next generations to choose this land or homeland. :) Peace be with all.

Then why do you want the GC ?

Anyway it's your decision. You can use your 140 to claim old PD. The process starts all over again with labor, 140, 485.

Even if your old employer withdraws this 140, you still have a claim on PD . I recall reading a memo by Rajiv Khanna on this site so just search around and you will get a concrete idea.

GC is for future employment.
Even if you go back .. U can continue with Ur GC process


Many of my friends who came early to US (17 years ago) , they got there citizenship and went back to India.

Some are happy .. lot of household help .. and driver to take U around. But other things are expensive out there and due to population pressure things are little difficult.
