Has DOS issued 50% EB visas till March 2006?

April bulletin is out. It is very disappointing for most of us. Now six months has gone in this year. It is very clear that DOS is still holding the date, just for the old LCs comes out of BEC. It appears that both DOS and CIS do not care about pending 485s. Therefore, there is a great potential for severe wastage of visa numbers at the end of FY 2006, if DOS has not issued at least 50% of total visas till March 2006. It is not possible for USCIS to approve any new 485s (that is going to be filed after April 2006), before the end of FY 2006, even if the new 485 carries PD in 1900s. Because they need minimum 6 months for 485 processing and thereby to request the visa numbers from DOS, when they about to approve 485. It is very much possible that more number of (at least 50%) visas going to be unused at the end of Sep 2006.

Now almost six months has gone in FY2006. Now we need to know whether DOS has issued at least 50% of the visa numbers by this time. I seriously doubt that. There is no public records available, to know monthly visa numbers issuance, by category. Now someone has to instruct those guys sitting in DC to move the dates fast, if they have not issued at least 50% of the visas at the end of March 2006.

Can anyone help us to know the status of visas issued till March 2006?

hi, per year only about 2600 visas per country per category are needed and hence it is easy to use those numbers up in a year. Can't blame DOL it is the basic economics of demand/supply. Unitl the legislative changes happen DOL can't help it.

Do you know about AC21 law, that eliminate country quota? If not, read that law and post your comment here.
 
AC21 law's visas were unused visas for 1999-2000 only which were country independent and they have already been exhausted in the previous year. So for 2006 it is only the 140K annual quota(which is country dependent) with about 2800 visas per country per category. Please allow free expression on the thoughts and don't be hindsighted. :D

AC21 has so many provisions. Whatever you mentioned is few. The main provission in AC21 is, in any calender quarter, if the demand for the visas are less than the supply for that quarter, the 7% country quota will be eliminated for oversubscrbing countries and they will be allowd to use the remaining number in that claender quarter. This rule is applicaple to all FY starting from 2001. It is not only applicable to recaptured numbers. Therefore, what ever you mentioned "AC21 law's visas were unused visas for 1999-2000 only which were country independent " is not correct.
 
do you have AC21's legislation? Then why do they have to recapture everytime the unused ones. Seems conflicting. hmm...
 
Based on the numbers on http://www.immigrationwatch.com/uscis-recent-approvals.html, there are 2182 approvals from 4 processing centers during January and February (except Nebraska which only shows approvals in Feb). Even if we assume all approvals are employment-based, this is clearly not on pace to reach the annual quota of 140K.

The average montly approval based on the data is (280+688+278)/2 + 936 = 1559. But the average should be 140K/12 = 11667 to reach the quota. That is only about 13%. There is clearly something wrong, I don't know whether we can trust the data from http://www.immigrationwatch.com
