HI heres the situation, my husband came here illegally in 1999 we got married last year and hired a lawyer to help us. We filed an I-130 in march of 05 and that got approved in June. but hes not eligible for an I-485 yet because now we have to get him an hardship waiver. Which means he has to go back to his country and go to an interview at the consulate there and there we will no what they decide . I know its a long story but I was wondering if anyone is in the same boat? If so right back I would love to hear whats happening or what happened!!!!!Im so nervous !!!

Hi, sorry for your situation, but the law is very clear on it.
A person who enters the country illegaly, even with an approved petition by a USC can't apply for adjustment of status inside the country. Plus is bar by the provisions of unlawful presence.
But before all this, if he is already in deportation proceedings?

he will be able to come back thats why this waiver is for to waive the 10 year bar from the united states. I was just wondering if anyone has been through this same situation and what the outcome was!!! thanks
 
Oh well in that case doesn't sounds so bad then. What your lawyer told you about what is about the interview, does he knows?

I mean I know that the interview is about the hardship to you and all that, but what is exactly the main questions (if your lawyer knows) and IF your lawyer should be present?

well the main thing is he haves to show hardship to me and the kids and they need to be sure that he doesnt have any criminal background in his home country. the lawyers not going but we do have an attorney that will be able to go if we choose. I hope someone reads this and has been or is in the same situation so they can give me some advice
