Has anybody received I-140 approval based on Yates' May 5 2005 memo?

Hi All,

I am wondering if anybody has received I-140 approval based on May 2005 Yates' memo. Has anybody received I-140 approval after they left the GC sponsoring employer?

Want to know if there are people in the same boat and got their I-140 approval based on Yates' new memo.

My lawyer said that the I-140 approval is valid but I don't trust her because recently she also received 3 I-140 denials.

now did your lawyer received this 3 denials after the 140 was approved, and pending 180 days of 485. or were they before the 180 days of filling. also did these 3 people had sent the AC 21 documents.

this whole thing on this forum nowadays is confusing lot of people here including myself...

guys how many are in process of invoking AC 21. and how many have already invoked this in last 3 months...this will give some insight of as to what others are thinking about this. and probably will help all.(i know my cousin he has invoked AC 21 2 months back.)

I am curious as to if you should switch jobs if your I-140 has not been approved even if its past 180 days since filing your I-140 & I-485. Isn't that risky?
 
AC21 issue we have to take with AILA, Lawyers that still USCIS is denying I-485 after 3 years of AC21 effective.

dont know why USCIS denying after 180 days of I-485 filing also after I-140 approval.

This is total unfair and injustice to all of us. bill to increase GC visa numbers also rejected.

USCIS is sucking lot, its total harrasment going, now only thing we can do is that sue USCIS.............

My lawyer told me that under the current interpretation of AC21, I am OK. But she also mentioned that the law may changed in future and become more restrictive. The law right now is very relaxed for I-140 applicants.

One thing I don't know: if the law changes in future and becomes more restrictive, does it mean I may get screwed during naturalization?

I was laid off from my GC sponsoring company and got my I-140 approved 16 days after I was laid off. I sent AC21 letter to USCIS after it got approved. But I was not working with the GC sponsoring company at the time it was approved.

Gurus.. can any of the gurus shed some light in my clogged mind?

PS: 3 I-40 denials qere based on ability to pay issue.. the applicants were in a startup and the ventor captial.... pulled plug on the company.. hence the denials...At the time of denial the company was scrambling to stay in the business..

I believe I am in a better shape...
 
from what i read, gathered, argued...over the past few months, this is what i know. you can jump after 180 days after 485 filing (as per yates memo conditions) as long as your past employer is not actively after you by going to USCIS and revoking your 140 sponsorship then you should be ok.

but if they try to claim that your commited a fraud while applying for GC with them, then you have problems. you ahve establish that you did not commit a fraud....to salvage your GC.

if you employer is Ahole #1 then i suggest using caution. if you think they are a professional org, then you may use AC21 to switch and send your papers to INS ASAP proactively ( i know there is a debate regarding this).
 
I485 RFE - urgent

I have the same issue:

1. I applied my green card process(140&485 concurrent and AP&EAD) from company A on substitute lab. in SEP-03. Got EAD and AP.
2. At that time I was working for company B on H1-b and continued my H1-B till FEB-04. Later I started using EAD and continued in company B.
3. 1-140 is cleared in 02-DEC-05
4. on 26-DEC-05 I received a RFE on I-485
RFE: "Submit an original letter on company letterhead from your current employer stating your date of hire, duties, remuneration and prospect for continued employment"

Both company A and company B are ready to help me. Ready to provide any information.

Do I have to provide company A details or company B details? What are the consequences?

Note: I never worked for company A.

Has anyone ported before I-140 approval using yates memo ?

I am wondering if anybody ported to another company before I-140 approval (assuming -- after 485 days of I-485 filing and similar job) ?. The company that filed my I-140 and I-485 went out of business and I ported to a new company, similar job and it isd way over 180 days since my I-485 was filed. There was a first RFE on my I-140 in Jan '06. Attorney responded to that RFE and we have received another RFE asking abt the company transfer. They assumed that the new company is "successor in interest" -- which is really not true.

Can the 5/12/05 Yates memo help in my case ?. Please let me know. I really appreciate yoru inputs. Lawyer says thre is no guarantee.
