HAs anybody received I-140 approval after leaving the GC sponsoring employer?

Leaving GC sponsoring employer before I-140 approval

Hi All,

I received my I-140 approval 15 days after I was layed off from the original GC sponsoring employer. My I-140 and I-485 were pending for more than 365 days. I am maintaining my H1-B status all thru out.

I am currently with another employer and performing exactly the same duties as with the previous employer.

Questions are:

1. Is this I-140 valid?
2. Can I use AC21? How safe is it?
3. Can I use this to get the I-485 approval? I have received RFE for birth certificate on my I-485.
4. Is there anybody in the same boat as mine.

Any response will be appreciated.

My 2 cents.

The preferred option would be to use AC21 if it works ( experts chip in ). This would be the best option for you as I as your I-1485 was filed more than 6 months back. However check with a couple of good lawyers before doing this.

The last option would be filing a new PERM / I-140 with new employer and keeping the PD of old LC.
