hardship waiver

I am ready to file for hardship waiver. I was funded by USAID, and my hardship is based on USC wife and daughter. My daughter is allergic to 20 different things, does not speak my native language,had a heart surgery op (for which was cleared) my wife has a rising career and is going to school for Physician Assistant, I left the program before completion, but since I have obtained an AA in physics and I am currently enrolled in a university using my I-485 receipt notice ( I am nacara eligible, but for some mix-ups my case was deemed abandoned due to my non-showing at the interview, a letter which I never received) My lawyer has sent a letter to the director of the houston local office explaining my case was unjustly closed because I never got a denial or an interview letter, and I haven't moved since 2003 (I possess a letter from TSC showing my right address when they transferred to houston). Made infopass, lady at the window says my case is common and I should file FOIA to reopen. My lawyer does not think so cuz FOIA is so lenghty. He sent a letter like I sd b4 to the director and wants to file for hardship. He is AILA recommended and he says his specialty is immigration and family, and he wants to send a hardship waiver to file AOS thru USC hardship concurrently. What do you think? my case seems simple and winnable compared to some other of your cases, and maybe is just because I am running out of patience. I have prepared for the worst though, for I have invested in my country and now have a little business run by my mom which will probably sustain me for 3+ yrs if DHS slaps me with a ban. Oh , I forgot to tell you we own a house, and honestly my wife would struggle to pay for everything by herself, let alone the career requirements (clinicals, hospital visits, etc) that she has as far as whom will take care of our daughter, especially during the 24-hr clinicals she endures some semesters. What do y'all think? I know USAID has a bone to pick with me and will probably not recommend a favorable decision. My friend already got denied, but she applied for daughter and hubby (both USC's), and I know part of the decision was based of USAID's ideas. let me know what you think or if you have any idea what's up with USAID
