my husband and i have both been denied entrance to the US and deported back to our home country due to working with our I140 still pending. shortly after both of our I140 petitions were approved. we now have to go on an extreme hardship waiver. however, only my husband has family in the US (his mother is permanent resident). the US consulate told us that only my husband has the right to apply now for a waiver. once approved and he has emigrated to the US, he can ask a waiver for me.
our question is: isn\'t there a way that we both can apply at the same time for a waiver, as we are considered as a family. how can they separate husband/wife for more than 6 months (min. expected waiting time)? - our process is done without lawyer!
