Thank you for your help in advance. I have certain concerns relating to supporting documents required from my side (as the primary H1 holder) for my wife's H4 visa. Here is my situation...
While on OPT my H1 visa was filed by my employer (Employer A). After recieving my I-797, I-129 and LCA from my employer, I went to Mexico and had my passport stamped with the H1 visa under this Employer A.
I then moved to Employer B and had my H1 visa transfered. I now have the new I-797 form from this employer but do not have the new I-129 and LCA.
Question 1: Can I use my old I-129 and LCA as supporting documents for my wife's H4 visa (to be interviewed in the US Consulate in Chennai) or do I need to get the new I-129 and LCA ?
Question 2: I have been working in the US for the past 2 years and have both tax returns documents and paystubs for the same time frame. Researching for supporting documents on the internet showed that I should have tax returns for at least 3 years. Will this be a problem in my case ? What should I do ?
Please advice !!
