Hi,
I am on H1B visa and it expires aug 2005. I am planning to go to India
by May 2005 . Can i get new H1B extension by that time. And also
since i cannot get revalidation with new H1B(revalidations cannot be done 2 months earlier than visa expiration) by that time, can i get my wife's
H4 visa stamping done with my new H1B paper (I-794 document)time line(valid till jan 2007), though my passport has visa only till aug 2005.

Absolutely, your wife will have no issue getting stamped with the new H1b approval notice. Infact, thats what she must do. She should not attempt to get the visa on a previous approval/visa(must not, if it is from an other employer other than the one you are working currently for). And for you, there will be no issue at all. You can come back on your old visa as long as it is valid by the time of return or you can get the new visa using new approval (if you get it by the return date). If you did not apply for the new h1 extension, i would suggest you to apply using premium processing. That way you can get it in a week and you will have no issues. Its worth it ! Its better to start after you get the new approval notice. But Dont let your wife attend on the old visa if it is from a different employer other than the one you are working for currently !!

Who said that new H1B revalidations cannot be done 2 months earlier than old visa expiration????
The reason why I'm asking it is b/c I'm in the same situation as yours, only I already have my new visa extension in hand(filed thru premium processing and got it back in 10-12 days), I'm thinking to go to canada next month to renenw visa i.e. 4 months ahead of old one expiring, called US consulate at Toronto , they said that there used to be a section that says that new visa cannot be issued 10 days prior to the old one expiring, but the lady at the consulate visa line couldn't find that law anymore. So she said that she thinks that they removed/changed it, but again she didn;t give me any definite answer, only said that she doesn't have anything in written regarding the timeline on which new visa can be applied.
So I would say do your research, they might have actually removed the 10 days prior law.
