H4 visa stamping - handed 221(g)

Hi,

My sister-in-law travelled to India in May. Her H4 visa appointment was in Late June. My brother H1B visa expired several years ago. However, he is applying for H1B extension based on the I-140 approval notice. He has a valid I-797 approval notice to be in status.

The VO at consulate asked my sister-in-law for a valid visa of the principal applicant (PA). She handed him a I-797 approval notice and said the PA don't have a valid visa. The H4 visa was rejected, and a white 221(g) slip was given asking for a valid visa of a PA.

This request sounds absurd. My brother is still in status with a valid I-797. Isn't valid I-797 enough for H4 vias stamping?

Please advise.
