H4 Visa Stamping - A New way ?

My wife's H4 renewal (I 539) got approved in Feb 2003, but the approval notice had a typo. It said Class as "H1B1" instead of H4.

My lawyer and I have been trying to get it corrected from BCIS, but so far .. no luck !

Now my wife needs to travel to India and since her old H4 visa-stamp has expired, she will need to get a new stamp in Chennai.

My lawyer says that she should be able to get a new H4 stamp in Chennai based on the approval notice for my H1.

Do you guys think this will work ?

You can't be sure of that. Sometimes they do give H4 on the basis of old H4 and and old expired h4 but when I called the bombay consulate they said, new h1 visa has to be there for H4 stamping.
