Hi,

I recently got married in Pakistan and want to bring my wide in the US on H-4 depdenent visa.(she will applying in Islamabad embassy)
The current H1-B visa stamp on my passport will be expiring in one month but I already have a new approval notice( for H1-B renewal) and my I-94 is valid for another 3 yrs.

I wanted to know:-
--Do I need to get a new visa stamp corresponding to my renewed H1B before my wife can apply OR can she apply based on the fact that I am here in legal status with valid work authorization and I-94.
--also will the visa duartion for my wife be based on my approval notice(expiry in 2011) or the stamped visa in my passport(expiring in 1 month)

many thanks

Yes, your wife can get the stamp based on your H-1B approval notice. She need to carry the evidence of your marriage though ...

your wife just needs to take the original copy of your new H1B notice (you don't need to get a new visa stamp) and her visa will be valid until the expiry date of your NEW H1-B notice.

However, please make sure that your wife takes all the necessary documents including (but not limited to): pay stubs, marriage certificate, W2/Tax forms, company letter showing you are employed, marriage photos, etc.

Good luck.
