I have an H-1 Visa. Then I started my greencard processing, and I already got my EAD. I-485 might get approved in a few months.
1. Now, is my H-1 visa still valid?
2. If I go to my home country and get married, will my spouse able to get an H4 visa?
3. If I am able to bring my spouse over here just before my I-485 gets approved, how long can she stay here??

Thanks for your kind help,
Regards...

Depends on the validity of your H1

If your H1 is valid for atleast 90 days you will be able to go back home, get married, get a H4 for her and come back to US. Once she is in US you can file 485 for her and she will be able to live with you. All these are based on your I485 not getting approved till you file 485 for your wife.

Good Luck.

Is 90 day validity mentioned anywhere on ins website or it is rule of thum.
I am in the same boat but my visa is going to expire at end of Dec'02.

Safety net

90 days I believe is a safety net. I am not sure if I have seen any direct references on any websites by Attorney.
