h4 visa for family

hello

I came to US for a research project on J1 VISA in Sept. 2002. My 8 year-old son and husband were denied J2 VISA at that time. We have applied 2 more times since then and have beed denied on all occasions based on "intending immigration". My research is ongoing and my VISA status changed recently from J1 to H1-B. I have H1-Approval till Aug, 2006 but the JI VISA stamp on my passport expired on July 31, 2004. I want to carry on with my research project uninterrupted for a couple of years but do not wish to be separated from my son and husband. They have applied for H4 VISA and will go for the interview at the Mumbai Consulate on Sept.3, 2004. We hope that they are not denied VISA this time and we can reunite soon. Is there anything in particular that we should keep in mind to avoid denial this time?

Hi,
I think the principal applicant, needs to have a visa stamp in the passport, for the dependents to get h-4 visa.So if you have a h-1 visa stamped, then your family should not have any problems in h-4.

Sorry, this is NOT correct.

The primary H1B holder does NOT need to have his/her visa stamped in his/her passport so that his/her family can obtain H4 visas.

The dependents have to have the Original H1B(if possible) or copy of the H1B when they go to the consulate for their H4.

There is no guarantee that the H4 for your family will be approved or denied.
It is however, very important for them to disclose all their previous denials,etc in their forms.

Because of the earlier denials, it might be difficult for them to obtain their H4.

I would suggest that you should obtain the services of a very good attorney as there are some other posts on this forum with similar difficulties.

Sorry, cant be of much help in these cases.Make sure that they carry all the proper documents along with your H1B (Original preferred, else copy).

It's good if i am wrong,and wish u all the best & good luck for h-4 visas for u r family.You Could just send a e-mail inquiry to the Mumbai consulate and check about it and also about the documents .i just read it in this forums and so expressed it in reference to it.Thanks GCChaahiye for correcting it.
