H4 visa - Extension of Stay

Hi all,

I'm on an H4 visa with I-94 valid till Mar 10, 2005. My husband's company had already filed for his H1 B extension and he has received a receipt from the USCIS office at Nebraska. We did not realise at that time that I had to file I-539 too.

Is it too late to file for an extension of stay for my H4 visa too(I have 13 days left...) or should I consider returning to India and filing for a new H4 visa?

Does anyone know how long it takes before you get a receipt number for the I-539 petition you filed? I've read that you require this receipt number before your visa goes out of status.

Also, can I travel to India and back while I wait for my H4 extension?

Thanks for any advise. I'd really appreciate any answers.

I was also like you and I submitted for H1 just before 15 days of expiring my H4 visa. Normally, if all the paper work is ready with the lawyer, you may get receipt number in less than a week. You can even file for extension after expiry but you have to submit the reason for the delay in applying. FYI, for H4 extension there is no premium processing. It's better not to travel out of country while your H4 application is in process. I have seen some of my firends getting query for this reason. just want to share with you.

My suggestion is to apply for H4 as early as possible (def better to file before the first one expires). Same case happened with me , my company applied for my H1 and they didn't file H4 and also didn't tell me that I have to file I539 for my dependents. I came to know after 9 months. I applied for H4 after 9 months. INS rejected that application after 6 months. Then I contacted one Attorney to resubmit the application with all the reasoning. Now we are again waiting for INS reply.

Thanks for your replies, Santhiksl and rsai. I got the 'Receipt Notice' with a received date before my I-94 expiration date.
My husband has got his extension approved at the same time too.
