H4 visa application Rejected

Hello Friends,

Here is the situation.
My friend had sent all the relavant papers for his wife and 3 kids H4 Visa application as the previous one had expired.

They had left to India 10 months back because of uncertain Job situations here and his necessity to travel frequently on the Job.

Now the Calcutta Consulate rejected on grounds of being seperated from husband for 10 months and wants proof of contact to show if they are still married.

He has no phone record (he has been only using phone cards to call India) or e-mails to show as proof nor Bank account linking.

Could anyone help my friend get through this... any advise would be appreciated.

If the husband and wife have any joint accounts, insurance policies, auto insurance, lease agreement etc. in US where both of their names appear together, it can be used as a proof.
If your friend has sent money to his wife in India recently, provide provide proof of those transactions.
If the kids have attended schools in US, try to show school records.
Your friend can ask his employer to write a cover letter to the consulate vouching for his marriage but I'm not sure if this will be a strong proof.
Another way would be to create a sworn affidavit in India through a lawyer where the wife will say that she is still married to her husband and both the inlaws (grooms parents & brides parents) will sign as witnesses.
 
Any letters that you have recieved at your US address in her name might help. Any personal checks that you might have sent her during her stay in india
 
she and kid can be accompanied by husband to go again second time for stamping if no record is available . May try .
