H4 to L1

Hi,
My wife has a H4 visa which she got 10 days ago in India (at Mumbai consulate).Now her company has agreed to do an L1 visa for her to work in the USA office and she has to file for L1 in India.My question is, if L1 visa gets rejected, is the H4 visa still valid ?

Is it possible to come to USA on H4 and file for L1 ?

Yes her H4 Visa will valid to enter into the US.

Yes she can come to USA on H4 & file the L1 petition in the US. If it get approved her status will automatically change from H4 to L1

Yes, she can change status to L-1 after entering the US on H-4. Her status will change to L-1 if the petition is approved. If the L-1 petition is rejected, then it means her change of status has been refused.. but not that her H-4 status has also been revoked. She can stay on H-4 status as long as her I-94 permits.

In the alternative, her company can file L-1 petition. In case of premium processing, it will take just two weeks. Once that is approved, she can get L-1 visa stamped. Even if L-1 petition is not approved by USCIS, she can always enter US on H-4.
