I'm on H1 and my wife is on H4 visa for more than 6 years. Our labor application is pending for 2 years and my wife wants to pursue her residency. With her 6 years on H4 we are told H1 is not an option for her, so we are thinking about J1.
With all the problems of J1 we are still considering this because this seems to be the only option for her now. Can someone please take some time and help/advice us how to go about this? Do's and Dont's? Is it possible to secure J1 after 6 years of H4? INS rules are not very clear on this. How can we make sure to get a J1 for straight 3 years instead of going for 1 year increment?
Please please guide us.
