H4 to H1B

Hi All,

This is regarding an acquaintance of mine.

What are requirements for H4 visa holder to get H1B visa? Both wife and husband are here in USA. Wife is on H1B and husband on H4. Since wife was sick for some time, they dont have recent pay stubs. Now husband wants to get H1B and wife wants H4.

If at all that guy is able to transfer from H4 to H1B immediately can he start working right away or he needs to wait till October 1st when the quota starts? Please help.

Any suggestions/comments would be greatly appreciated.

You will need to wait till October. Your H1B will come under quota that gets started from October. If it would have been a H1b-to-H1b then you could have started immediately.

Thank you for reply... but can he apply with out having any documents from his wife? He has all documents pertaining to his job offer/his employment.

Also, Can he stay in US legally... his wife's H1 expires in June. He has 3 months before October.
