Hello:
One consulting company filed my H1b (change from H4 to H1b) In September 2004, which got rejected at first, and the company didn’t inform me that they are repealing the case and now I got an H1b approval in February 2005.
Meanwhile I applied a change of status from H4 to F1 in November and case is still pending. The employer has not yet got any project for me.
I had applied for F1 at NSC where they are processing January 25 applications. My question is that is it because of my H1b approval my F1 decision is getting delayed? Can I reapply for F1 through my H1b, which is not valid because I haven’t joined the company? Or can I reapply for F1 based on my new extension of H4, which came in January 2005? Can you please help me?
