H4 to H1

i have two questions

presently i am on H4 visa ,my husband 6 years period is going to end by july.he is going to apply for 7 year extension,we r on labour processing,now CAN I APPLY FOR H1? my doubt is now if i apply for h1 at my time of my processing my husband h1 will be expired. can anybody explain me detail.

i am applying for h1 for first time from h4 to h1.
with the reciept can i work?

---- If you have spent 6 years on H4 then you cannoyt apply for H1, as the H status is counted without distinguishing between h1 and h4. If you still have time elft on H status if ur husband applies for his H1 ext and ur H4 ext i think u should be fine. Please wait for other responses or talk to a lawyer
