H4 to H1 without Paystubs!

Hello guru's, please respond....:confused:
I have been watching this forums for long time, thanks to all who respond.
I have a friend who was transferred from h4 to h1 oct 2007 and employer couldn't find job for her SO, no paystubs even though she got SSN in Mid Nov 2007. Now, she has to visit india in jan 2008, what are the options she had?
1. can she come back on h4 if the h1 is not stamped?
2. I-94 of h4 and H1 is the same, is that mean anything?
3. If the Paystubs are necessary then how many # of paystubs would be reliable?
Can she re-apply h4 while being in india and again has to go for visa stamping in india?

Answers below:
1. If your friend's H-1 stamping is denied, then all other temporary visas become invalid. Other option for your friend is to opt for H-4 stamping (provided the current H-4 has expired).
2. Yes the validity period for both H-1 and H-4 can be the same.
3. Furnishing paystubs is at the discretion of the visa officer. In general it serves as a proof of H-1B beneficiary's employment.

My friend had only 1 paystub in 2007 and a w2, but eligible to work from mid nov 2007, is there many chances of denial?
