H4 to H1 (Spouse H1B nearing 6th year completion - LC not filed)

Hello,
I have a question regarding H4 to H1 conversion. Here is the situation:
My sixth year on H1 is currently running and will be finished by DEC, 2004. My wife came on H4 in 2002 DEC and I found an employer who is willing to sponsor her H1 visa (2005 Quota ) immediately. I have question regarding the duration of my wife’s H1 visa if it is approved since my 6th year is currently running. Will she get H1 visa for 6 years or 4 Years?????/

Also will she be eligible to get H1 visa????

She would be eligible from 10/04-12/04 for H1. Not beyond that.

I take it back. Sorry, after replying to someone else, I reread your Q. 10/04 she would have little less then 2 yrs. on H status, so she woule be eligible for additional 4 yrs. But you cannot take advantage of her H status.
