I urgently need your valuable inputs for a ouple of questions.
1) My wife is coming to U?S arnd March 10, 07 on H4 visa. There is a consultant ready to file for her H1 on April 1 for the oct , 07 quota.
My questions is , is there a minimum duration that she must be in US before applying for H1 with a change of status together with it. ( I want it to e filed at the earliest). Or if there is a time limit, can we just file for the H1 and then do a COS once the H1 is approved. What is the advice on this.
2) We want to do a premium processing.. So in may if we have the petition can she begin to work immediately. Or does she have to wait till Oct, 07.
If she has to wait till Oct, what is the use of premium processing.
3) If she leave US while the H1 is under processing, can she reenter on her H4 and then file for COS to H1 immediately on entering if H1 is approved. Is there a waiting time to do the COS.
Appreciate your help on this.
