My wife has H4 Visa stamped till Apr 2011, her H-1B pittetion with COS was approved in Nov 2010 and new I-94 was sent to attorney, However her company attorney lost them
and has applied for duplicate I-797. Can some one let us know,
1) Can she apply for SSN and start working based on I-797C(Courtesy copy that the employer recieves), with out original/copy of I-797
2) if she can not apply for SSN and work untill she receives her Duplicate I-797, what would be her status, will she be consiedered H1 or H4 staus
