My wife got her H1B approved very recently(change from H4 ti H1). The consulting company is not paying any salary and therefore technically she is out of status since 3 months.
My question is does her status affect the process of my green card process that I have started few months ago ? Please let me know.
And I have an other question regarding the visa stamping on her passport...
Can she send the passport for visa stamping with the H4 which is valid till end of 2002 and can still work on H1 ?
She is planning to go to India for H1 visa stamping anyway after few months but to be safe and to return back to US even if her H1 visa stamping gets rejected , She is planning to send her passport for revalidation on the H4.
Please let me know.
