Greetings,
I hope someone will be able to shed some light on the issue that I have.
I have a master's from US and so, as things were originally mentioned by the USCIS, I fall under the 20,000 cap. I am on H4 now - and have a job offer. Since the 20,000 visas are not yet being issued, how can i start working now?
1) Should I file my H1 with a start date of Oct 1 and hope that they will allow me to change the start date to an earlier date, when they have cleared the issue with the 20,000 visas?
2) What happens to my application if i file with an earlier start date, say May 30th, 2005? Will they automatically transfer my application to the Oct date, if they decide that there is going to be no earlier start date? What will happen to my application, if they make a decision about the 20,000 only after my requested start date has passed?
Someone please tell me what is my best option. I am confused and do not want to lose 'yet another' job opportunity because of the Visa issue.
