I am under the dilemma whether to go to Canada or Chennai consulate to get my wife’s H1 visa stamp. I am not sure which consulate is safe and would greatly appreciate your inputs on this.
Here’s the details:
My Wife entered US on H4 in Jul 2001 and received her H1 approval in Nov 2001. But she started to work only in June 2003 as she could not find a client to work before. From June 2003 onwards, she has been on project and has all the pay stub and w2’s. I am really worried if the officer at consulate asks for w2 from Nov 2001 to May 2003. Can we show this period as leave of absence without pay?
Is it safe to go to Canada or Chennai consulate or to just wait for EAD/AP (have labor and i-140 approved, waiting for priority dates, Jan 2006). Has anyone been in similar situation and had successful stamping?
