I am currently on H-4 visa ( valid and stamped till Dec 2008).
I have applied for H1-B visa under this year quota on April 2 , 2007 and now waiting for my H1B to get processed.
I am planning to go to out of US ( to India ) on May,
15 , 2007 ...
If I come back on July 25th, ( that time may be my H1 B will be under processing ..if my file gets selected in lottery
) ,
At Port Of Entry ,I think I will get enterred on US onthe basis of my Valiod H4 stamp ...right ??. In this case,later in Sept/Oct if my H1b is approved can I get visa stamped on my passsport by going again out of US to change my status from H4 to H1, sometime
in October to start working ?
OR
in above case I will looose my H1B processing case and
to start work I have to apply for H1b all over again?
If you can suggest on this scenario it would be appreciated.
