Hi I have H1 visa from Company A. My wife is with me on H4. Both of our visas and I94s are valid till Oct 2006. 3 months back we have applied for her H1, it is approved and will be effective from Oct 2005. We did not get her approved documents in hand yet.
Now I am changing to Company B and they are applying for my H1B transfer.
While applying for H1B transfer Company B is also applying for extention of my H1 till Oct 2008. They said they will also apply for my wife's H4 visa extention.
Is it OK to apply for my wife's H4 extention till Oct 2008 while her H1 visa is approved and will be effective from Oct 2005?
What will happen if they apply for her H4 extention? Will her approved H1 will be cancelled and will she stay as my dependent(H4)?
Is there any danger where she might become out of status here?
