H4 to H-1 Conversion help

Hi,
I'm a new member here. I was working in Dallas till last year. Got laid off and converted to H-4 (My wife is also working). Our visas expire in Jan 1st, 2004.

The attorney at my wife's office applied for renewal only in Nov 3rd week. From the USCIS site the expected date to get our renwal is by (150-180 days)May for my wife and by March (60-90 days)for me. Now I'm getting a lot of interview calls and some of them are progressing well. In case I get a job in Jan what all issues I have to face ?

1) Can I apply for H-1 before receving my H-4 extension validation paper ?

2) Do I have to wait till I get my H-4 and then apply for H-1 ?

Please advice. Thank you all.
 
You should withdraw the H4 and apply for a new H1. Make sure that you inform the prospective employers that you can start working only after H1 approval.(premium processing and a quick trip to an US embassy)
 
Hi Jaxen,
My H-4 expires in the first of Jan -2004. As it is too late now to apply for H-1 in the next 3 days I'm thinking of doing it in Jan. Can I withdraw the H-4 application after Jan? Will they consider me out of status if I do the H-1 B application after Jan 2004. ? (As my H-4 expires on Jan,1,2004)

You said a trip to embassy. Did you mean that to get the Visa stamped?

I can work once I get the Visa approval receipt right ?
