Currently I am in the process of H4 to F1 conversion, My H4 got expired in april end and I am here legal since my F1 is under process. But I received RFE from uscis asking for few documents from my husband (His H1b approval notice and copy of I94 card) but he is refusing to give me the document. I am currently not living with him. Now I atleast want to take care of my life, I am going to ask some time from uscis that he is refusing to provide the document and I am gonna file a lawsuit on him to get the documents, but dont know how much time will uscis provide me, the case might take 6 months to finish. I need to stay in usa till oct legally so that I will get my h1b approved. H1 is filed based on the F1 to H1. Usually how long does uscis take to process RFE for F1 case and H1 case. Anybody has been in this situation. Any Help is greatly appreciated.
