Hi,

My husband applied for H1 transfer last year in November (02) and I applied for a H4 too with him. After a RFE in May 03 his case was approved on dec 03. Meanwhile I left to India on Oct03. My husband is planning to visit India in feb then get his visa revalidated. Can I get H4 stamp after he gets his H1 stamp or do I need an approval(I797 for the h4 that I applied last year) ?

As sson as you left USA, your H4 was abandoned. Your only hope to join your hubby is to get the H4 from the US consulate in your country. It will be better to get the H4 stamp during H1 revalidation, however there is no harm in applying for H4 based on H1 approval (since you already have a h4 stamp in your passport)
