My wife, is on H4 visa. Currently she is in India and scheduled to come back to Kansas City on 1st of December.
I am on H1 b visa here with a valid visa stamped upto 8th Dec 2005 . I have got a H1 renewal valid upto August 2006.
As her visa was outdated, she appeared in Mumbai consulate India along with all the necessary documents for a new Visa but to our surprise the Mumbai consulate has given visa only up-to 8th December 2005.
I assume that the officer in India ignored my new H1b petition (valid till 8/28/2006), her extension of stay H4 petition (valid till 2008) and instead looked at old visa stamped in my passport which expires on 8th December 2005.
I am not clear about the reasons why they have done so.
I need an advice from you on the situation we have got here for my following concerns:-
1. While she does port of entry here, what kind of questions she is expected to answer?
2. If the Immigration officer gives her a I-94 up to 8th December only, what can we do?
3. Will this I-94 override the I-94 attached at bottom on approval?
Your help is highly appreciated in this regard.
