H4 stamping - Guru's please advice

Hi all,

I have a valid H1B visa on my passport untill May 1, 2005. I got my new H1b approval last week and it's valid until Nov 2006. I am leaving country around march last week in order to get married and planning to send my wife for H4 Stamping. After Marriage, i have planned to return U.S on April 20th using the existing visa on my passport which is valid until may 1, 2005. Now my question is can i send my wife for h4 visa stamping based on my new h1b approval?.

Hello avles,

Its depends on the start date of you new H1b approval. If the start date on your new h1 is on or before your return date, i suggest you have your wife apply through your new h1 (best thing to do if this is from a new company irrespective of the start date) else if the start date is after the return date i suggest you to have your wife apply using the existing visa in your passport. This way you dont miss each other and everything will be perfect. But dont forget to show your new h1 when you come through the Immigration in USA on your return. Because you and your wife need to have the new I-94 stamped with the new expiration date of your h1. Hope this information helps. Wish you good luck and Congratulations to both of you.

Thanks a lot for your reply. Actually both my previous and new h1's are with the same company and my new H1b approval starts from May 2nd 2005 until
Nov 2006. So, is that ok if i attach both my old h1b approval which is valid until May 1, 2005 and new approval for my wife's h4 Stamping and leave it to the consulate. Thanks again for your wishes.
