First of all A very happy new year to you. I had a Situation here which I have explained below. I would really appreciate if you could go through it and answer my question.
1. I ,my wife and my son had a I-94 valid until October 1st 2001
2. I changed my employer and I got my I-797 and I-94 which is valid until April 2004
3. But My employer did not apply for I-797 for my wife and my Kid.
4. So now they do not have a valid I-94 and their I-94 has expired since October 1st.
Now I have to send my Families Passports for Stamping, and I have couple of questions.
1. Do they need a separate I-797 for stamping as they do not have a valid I-94? If yes can I apply for it now?
I would appreciate a fast reply.
