H4 Question

Hi All,

Me and my wife have been here for 3 years, she on L1 and me on H1. Now, she may have to let go of her job because it would mean more travel, we therefore want to convert her to H4. Could anyone let me know :

1) Is there an online application for h4 ?
2) Do i HAVE to go thru a lawyer ?
3) Is it possible to get this conversion by not leaving US ?
4) What could it possibly cost ?
5) What could my current H1 employer do to expediate the process ?

You'll have to apply for her H4 visa at some US consulate outside US. She will need to fill out DS-156 stating she had a L1 visa. You dont reuire lawyer. U will need wedding album,wedding certificate,letter from ur company[EVL], ur pay stubs, last yrs tax returns etc...check list on US consulate website. Its costs approx Rs 7400 in India.

So, getting back to my questions, does that mean she will have to leave US and then apply H4 from a US consulate office (outside US) and then come back ?? can she not apply for H4 being here ?

I believe she has to be outside US for getting H4 visa. check with some attorney if this can be done inside US.
 
you can apply for a change of status from L1 to H4 within US. You dont have to get your visa stamped. Visa is required only while entering the country.

Talk to a lwayer and he can apply for the change of status with the US. If she does not get an I-94 with her approval notice than she will have to go out of the country get a new H4 stamp and then enter US with a new I-94. Just make sure that her I-94 is valid all the time she is the US.
