Hi, My wife applied for H4 in US consulate Bombay. She submitted all the documents required by them, my H1 papers, company tax returns, my W2, company pictures etc, and the embassy has told her that INS is still not convinced if my company exists. They said (on July 1st) that they will conduct an independent inquiry and will let her know how to proceed. I am the only employee left in my company as my employer works for another company.

Please share if some thing like this happened with any one else and how long will it take for INS to complete their inquiry. Can I do some thing here to speed up the process.

Thanks a tonne

"..I am the only employee left in my company as my employer works for another company. "

No normal company will have only one employee, that too on H1. No wonder the consulate is investigating.
What do you mean "my employer works for another company"?

My company is a consulting company. I have been working with this company for 4 years. My employer owns 2 companies and he consults through his other company. My company had 6 employees in 2000, 4 in 2002, but now others have moved on to other full time positions..

I will repeat what I said before, A one employee company does raise issues about the legitimacy of the business. It is plain common sense, more so with stories of imaginary "consulting companies" operating out of someone's living room using H1 to bring people to US.
US consulate is well justified in conducting such an investigation. You have no choice at this time other than to wait and hope the investigation is completed quickly.
Good luck!

Thanks a lot for your inputs nkm-oct23. I really appriciate it. I am really confident about the validity of the company and my status but I was more concerned about the time taken by such inquiries.

Did you ever come across such case and do you have idea how long this kind of stuff would take?

No, I have not come across any such cases but my guess is that you are in for a long wait, a few months at least. All US consulates now have to interview most applicants and this has added a lot of workload.
