I came to Us on F1 in 98 and studied for 2 yrs in a finance masters course.
After that I got my 1st H1 which recently expired on 15th Jan. Have worked mostly in big known banks during 1st H1.
I am also studying at Carnegie Mellon for a 2nd masters in finance course since last year and
the course will finish at the end of 2004 or early 2005. Have done reasonabely well at Carnegie.
My last employer did not extend my H1 for a 2nd time so I tried got a new H1 thru a consulting company
which was denied few days ago. I think it was because I primarily had finance background and this consulting
co is a computer co and the consulting co also says it is probably the cause.
My wife who was here on H4 since we were married last yr also got her H1 thru the same consulting co
and her transfer from H4 to H1 was approved in december, 2003 and she is working thru that consulting co
on her H1 since Jan 1, 2004. She has an IT background.
I am currently out of status after expiry of 1st h1 and denial of fresh H1.
I know I have to go to India to get a fresh visa stamped and then come back with a new I-94.
I am not sure if I should try for H4 or F1 which is my delima
Incase of H4 I feel since my wife just started working and the consulting co is not a big name
I don't have a good case as there would be few docs from this new company of her's and only a couple of
pay stubs. So her job stability can be questioned as being very new and hence my H4 denied even though her job is
stable. Also since my H1 was denied thru the same co and if the visa officer at the consulate knows this
I would be hard pressed to explain my case. Also when I go out of US now my illegal days stay here even though
they would be less than a month if I go now. On the flip side h4 seems like a logical choice asmy wife is in US
on H1 and even though her job is new and few pay stubs its a valid H1.
On the other hand Carnegic Mellon is an ivy league school and very well known for finance courses and I feel
I can build up my case better with docs and letters of recommendations from professors andsince I have already
completed one yr there it might be easier to explain why I want F1. The flip side for F1 is that I cannot
show an intent to migrate and will say that after I finish my college at the end of this yr and my wife has
worked for almost a yr we will come back to India. Visa office will already see my 1st F1 and H1 also and I am
not sure if it helps or not. Also in this case I think it would help if I say my wife is in US on H1
and I applied for F1 not H4 because my last employer told me about not extending my H1 only a few days before my 1st
H1 expiring and I had to stay back to make arrangements for my wife to be able to stay alone and also travel
arrangements. In this way I can explain my few illegal days if the officer finds out that I overstayed by
looking at the arrival stamp date in India.
I would like to know whether I should go for H4 or F1 considering this situation and why choose one over the other?
