I have a H1B visa and my I-140 has been approved (priority date July 26, 2005 ). The I-485 is still pending.
My husband is in China working for a US company (Chinese employee). In the past year, he visited me and attended his comany meetings using B/B2 visa. The visa is expired now. The company will send invitation letter for him to apply for B1 visa again for this year's meeting.
He can also apply H4 visa for visiting me. Actually, we prefer to have H4 visa because we may want to submit his I-485 if the priority time becomes current.
The questions are:
1. Because of my greencard application (I have an A#), do you think he would have some problem to get his visa?
2. What would you recommend: to apply for B1/B2 as before, or apply for H4, which might be easier to get? why?
3. I think B1/B2 visa can convert to H4 visa when he is here, right?
Any suggestions and recommendations would be greatly appricatied.
