A friend of mine needs clarification regarding some H4 issues.
He intends to marry a divorced lady who recently got her court
papers. She currently has the name of her ex on her passport.
The same applies to her 6 yr old son's passport as well.
1. Can he marry her and sponsor her H4 ?
2. Does she have to change the name of her ex to that of my friend
when applying for the H4?
3.Can my friend claim the son as his dependant ?
To add to the anarchy, she had applied for Canadian immigration.
Towards that end, she needed to come to the USA for an interview. She
applied for a visitor visa with the name of her ex on her passport
since she was still legally married to him and had not got her court
papers. Of course, the visa was promptly rejected on the basis of the
usual "possible immigrant" clause.
4.Would this unproductive risk hamper the new H4 application ?
5.Does he have to be physically present in India to marry her ? This
is regarding the marriage certificate, photos etc.
