H4 I797 approval document missing

Hi Sir

I am Shafi, I filed my H1 Extension along with H4 (Wife and daughter) in 2022 and it looks like I received only I797 approval for me and my wife and not for my child. I did not notice this until it is time for renewal now in 2025.

My I797 along with wife H4 I797 is valid until April 20 2025. As per my employer's suggestion I filed my H1B extension alone in premium processing which is in progress for now. In order to file H4 extension for my wife and daughter they require a copy of current I797 and my daughters I797 is missing. I raised FOIA for my daughter's I539a approval from 2022 but USCIS response came back they are not able to find it.
On the other note my daughters Indian passport is about to expire on Feb 10 2025.

Now my question is
1. Is there a way to file H4 extension without daughters current I797 approval notice, if yes what all I should be including in place of current I797 approval and can I have it done in premium processing by chance.

2. As my daughters Indian passport is going to expire on Feb 10 2025, one of the requirements is to send them a copy of current I797. How do I renew her Indian passport. My daughter is in 10th grade and we don't want to go back to India for stamping now. Please suggest. Thank you!!

Hi , Is your issue resolved? We are in a similar situation where child's approval notice is not received and passport is due for renewal. Please share your experience if the issue is resolved.
 
Yes, it is resolved.
1. In my case I had filed an affidavit and notarized it explaining the situation and called CGI several times explaining the situation. Finally they approved and granted passport with a validity of three years.
2. Also I had my employer sent an email to USCIS TX processing center on the missing I797 receipt and approval as I filed at that time in prermium processing. They responded back and send me approval notice. However by the time they sent I got my Indian passport.
