H4-H1 transfer

Hello

I got my notice of approval for H4-H1 transfer .

I am planning to travel out of country.

Before re-entering is it necessary to get my H1 stamped or can I travel back on my H-4 and still work with my I-797 approval?

Since u are status change, u have to get ur stamping in ur home country only. As u said u can comeback with ur old H4 stamp. But if u need H1stamp on ur passport u need to go back ur ur home country and get stamp.

so better u get stamp this time itself...
 
hi,i am in the same situation .i need to fly to canada for my pr card .i called INS,they said my H4 stamp is not valid any more,since i changed to H1.I cannot return back to USA only base on my H1 approval.I need to get a H1 visa at canada then I can come back.
How do u think? I donnot want to take risk.
 
That's not true that you have to back to your home country in order to have H1 stamped in your passport. I was on F1 and got H1. I went to Canada with all papers and letter from my employer, and got a new H1 in my passport without any problems. Oh, btw, I had my original US BS diploma. There is a lot of papers in the process, you are better off if a lawyer can help you prepare a packet before your trip.

My understanding is that once your H-1B has been approved, and you come back on a H-4, your H-1B is not valid. If I were you, I would obtain a H-1B stamp. Also I am not sure if you can go to Canada to obtaina a H-1B stamp if you are not a Canadian Landed Immigrant. Send an e-mail and see what the consulate will say. You will have to be very specific in your e-mail. Make sure you include, that you have only a H-4 stamp in your passport, and never had a H-1B stamp.
