h4-h1 receipt date Dec 10,2004

I filed with Nebraska center to change my status from h4-h1, the receipt date is Dec. 10, the most updated processing date according to uscis website is Jan. 1, 2005, I wonder why my case is still pending. :confused:
 
its like new H1

You r applying for a new h1-b visa...therefore, u should not apply till april for the 2006 quota. THe quota for this year 2005 is filled. Ask your lawyer for confirmation.
 
Thank you for your reponse, I forgot to mention, I was on H1B until July, 2004, I am not subject to the H1b cap.
