H4-H1, If H1 stamping refused in chennai can i get H4 stamping done?

Hi,

I will be applying for consular processing for my H1. I am planning on getting it stamped in chennai. right now I am on H4.

My question is when I go for H1B stamping, if they refuse the visa( stating some reason) then can I take another appnt for my H4 stamping(since my status would have changed to H1) will they give me H4 visa cuz my husband's H1 is valid till 2008.

Please please somebody help me out

Absolutely.

If you go for Visa appointment based on your H-1B, the consular officer will review your H-1B related documents.

If you go for H-4 Visa appointment based on your spouse's H-1B, the consular officer will review your Spouse's H-1B related documents. There is a 99% chance that they won't even look at your history (they are very busy).

Additionally, if your H-1B visa appointment was denied, please make sure that you state that denial truthfully on DS* forms.
