H4 -> H1 -> GC (Spouse)

Hello Folks,

I am planning to concurrently apply I-140 & I-1485 with myself as primary applicant with an approved LC.

My H1B expired on 07/20/2003. Waiting for Extension approval.

My wife's H4 expired on 07/20/2003 and I did not apply for her H4 extension, as I applied for her H1B last year and got approval until Dec 2004 with I-94. But she doest not have any paystubs as yet.

Now, I am planning to concurrently file I-140 & I-485 ( both ). Can I mention her current status as H1B in the GC forms or will BCIS may ask for her paystubs too ??

Since u are the primary applicant, the BCIS will not ask pay stubs of ur spouse.
