H4-H1 employment start date....

I already had H1 once before. I went back to my home country and came back as a dependent (H4).

I am aware of the fact that I don come under the cap anymore and any employer can file for a H1 visa for me at anytime.

If an employer files a H1 Visa for me what is the date I can start working for him.

You do come under a cap since you will CHANGE status to H1. You can begin working once you receive approval notice with a new I-94.

Yes, any employer can file for an H1 but it will be approved only when the quota is still available.
