Hi Guys:

I am aving for india in January 2004. I have to go for an H4 stamping for my wife..

What are the documents I need to take for the stamping.

I live in chennai. Can i get her H4 stamped in Bombay.

Will there be any questions arised because I live in chennai.

Also, My employer promised to pay me X amount of money when he sponsered me. I was not paid the same amount until last six months. I have heard that the consulate is Asking for W2's and pay stubs for the previous years.

What should I do in this case.

There are no definite answers to your questions but there definitely can be suggestions:

I think before Chennai people were allowed to go to Delhi to get visas so I would think it would be safe to go to Delhi than Mumbai and also may be there is more chance of getting stamping done in Delhi.

Someone should respond who had a similar case like yours.

As far as the list of documents is concerned it's best to look at the consulate website where you want to go because the list is a bit different e.g. Delhi need original 797 of the H-1 whereas Chennai is happy with the copy also.

For the last question where you are saying that your employer promised you some salary and didn't give that. The actual case is that whatever is mentioned in petition and Labor condition application that is what matters, if you got more than that or close to that you are safe. Definitely take all the paystubs with you as much as you can.

Chennai one had a huge backlog of applications and therefore has allowed applicants to go to other consulates. It is no longer the case and if you belong to south india you have to go to Chennai for your visa.

Unfortunately Chennai Consulate has been very particular in ensuring that all visa applicants get paid acording to the LCA. The law requires the employer to pay AT LEAST the salary promised in LCA. Benching without pay is strictly not allowed. Many body shops have flouted this rule and you probably are one such victim. By not paying you as promised in LCA, your employer has violated one major requirement of H1 status. Going by the experiences of others you can expect to have problems in your H1 or spouse's H4 visas at Chennai.
