H4 extension after getting arrested on shopelifting case

Hi There,

One of my friend living in US on H1 visa for more than 6 years. He is currently living in us on his 7th year extension and ready to apply for 8th year extension. Recently his wife got arrested on shopelifting by some misunderstanding. they went to the court and judge accepted to remove the case from records after 1 probation class. They did removed the case from records.

Now, my questions is whether she should say "yes" or "no" for the question "If you ever got arrested." while applying for h4 extension and / or in DS 156. If she say "yes" what would be the consequences.

I am not sure if anybody got this kind of experience. But, please share your ideas and findings.

I believe she has to say YES -- it doesn't matter what happened subsequent to the arrest - the answer is still YES.

Ask her to carry all of the disposition papers in her case - copies of everything - court order etc etc
should be ok.

She would have real trouble if she lied and said NO in the form and it comes out later !
Safest bet is to say YES and provide all the required paperwork.

Thank you for the resopnse. What would be the chances of getting H-4 visa extended if she say "yes"?
