H4-Divorce

1.I'm going to file for H1 next week.Can't I have a F1 and H1 visa processing pending at the same time.

2.While H1 and F1 processing are pending if my H4 gets revoked due to divorce what will be my status .Should I do soemthing to maintain status or will I be in status as MY H1/F1 visa processing is pending.

1. Right now your best bet is F1. You cannot apply for a new H1 until April 2004- even then the effective date will be 1 oct 2004. You can have H1 and F1 pending but they will not serve any purpose. Since if one is rejected for some reason, the other is also likely to be rejected.

2. Illegal status. If you rack up more than 6months of illegal time you will be barred from the US for 3 years.
